"Judge OKs 'truth serum' for Colo. shooting suspect"

"...Suspect James Holmes could be required to submit to a 'narcoanalytic interview' as part of an evaluation to determine if he was legally insane at the time of the July 20 shootings, Arpahoe County District Judge William Sylvester said. A narcoanalylitic interview is a decades-old process in which patients are given drugs to lower their inhibition. Academic studies have shown that the technique has involved the use of sodium amytal and pentothal, sometimes called truth serum."

"Karen Steinhauser, a former prosecutor who is a law professor at the University of Denver and a defense attorney, said she could not find any case law about use of the narcoanalytic interview."

FLASHBACK ONE YEAR:

"A Chicago man who confessed to one of the most shocking slayings in the city’s history and paid for it with more years of his life than any Illinois state prison inmate has died. According to the Cook County Medical Examiner’s office, 83-year-old William Heirens died March 5 at a Chicago hospital after officials at Dixon Correctional Center found him unresponsive in his cell. ...Mr. Heirens was a 17-year-old University of Chicago student and petty burglar when he confessed to killing two women in 1945...and the abduction, slaying and dismemberment of a 6-year-old girl the next year. ...In the ensuing decades, Mr. Heirens sought release from prison some 30 times, claiming that he was innocent and that he only gave a 19-page confession after police sedated him. ...In 2002, the Associated Press reported that students and law professors at Northwestern University who had worked to free other inmates had taken up his case. A clemency petition submitted to then-Gov. George Ryan claimed Mr. Heirens was given a spinal tap without anesthetic in one instance. One of the attorneys who prepared the clemency petition, Steven Drizin, said it also argued that police acknowledged that they gave Mr. Heirens sodium pentathol, a so-called truth serum, and that after that injection he made some admissions."

Although denied by "Lieutenant J.D. Knight...[and] Captain Vince Sauter of the Arapahoe County Sheriff's Office", a possible jail informant named Steven Unruh makes several remarkable claims about an alleged conversation with James holmes. (Apparently, "[Unruh] has a form that indicates James Holmes tried to send him a letter, but it was rejected by jail authorities. ...Knight says he has no record of any letter sent by Holmes to Unruh, intercepted or otherwise.")

"What Unruh can prove is that he was booked into the Arapahoe County Sheriff's Office Detention Facility on drug and theft charges at 6:44 p.m. on July 19 -- just hours before the attack in Aurora at a midnight showing of The Dark Knight Rises that left twelve dead and dozens wounded. Unruh says he was still in the booking area when officers brought in Holmes, whose head was initially covered with a hood. ...[I]n an interview that took place several days before [Holmes' behavior was widely reported,]...Unruh described... [Holmes' running...(and) slamming his body and his head into the (jail) wall]."

"[Unruh] says that Holmes told him 'he felt like he was in a video game' during the shooting, that 'he wasn't on his meds' and 'nobody would help him.' He says Holmes also mentioned NLP -- presumably, neuro-linguistic programming...-- and claimed to have been 'programmed' to kill by an evil therapist. 'When he got out to his car, he wasn't programmed no more...'."
